For Counties
The new state law developed by Attorney General Andrew Cuomo builds upon existing law that allows counties to reorganize local government. This includes towns, villages, cities, districts, special improvement districts, and other districts created by law. Below you will find simple instructions on what a county needs to do and how the process works.
I. Develop a Plan
If a county wants to consolidate or dissolve or transfer and function or service of any governmental entity the county legislature must pass a resolution or local law to begin the process.
II. Referendum
As required by the New York State Constitution, a special referendum must be held. The Constitution requires that a majority of voters in the cities in the county, a majority of voters outside the cities in the county and, if villages are effected, a majority of voters within the effected villages, must approve the county’s plan.
